- You warrant that you own or have the right to use any Submissions; and
- These Submissions (including any intellectual property rights in the Submissions) shall become and shall remain, the property of Moto, once submitted, (as your submission shall constitute an assignment of your rights in these Submissions).
You must not submit any of the following special category personal data: racial or ethnic origin; political opinions; religious of philosophical beliefs; trade union membership; physical or mental health or condition; sex life and sexual orientation; biometric or genetic data; or any personal data in connection with criminal allegations, proceedings or convictions.
We have the right to remove any Submissions you make on or through our website if, in our opinion, such Submission does not comply with any of our website terms.
7. TERMS AND CONDITIONS RELATING TO SALE OF PRODUCTS AND SERVICES VIA OUR WEBSITE
Your Account for Food and Beverage Orders
These terms and conditions of sale (“Terms of Sale”) apply to any order you place through www.moto-way.com for products such as food and beverages and any related products you purchase from Moto. By placing an order through the website, you confirm that you have read, understood and agree in full to these Terms of Sale. If you do not agree in full to these Terms of Sale, you must not order any product through the Website.
To place an on-line order, you must open an account with us which will require you to provide some compulsory personal information. Please see our Privacy Policy and our Cookies notice for more information on how your personal information will be used.
You confirm that all details and information that you provide to us (including on registration) are accurate and up-to-date in all respects. You may update or correct your details at any time by going to your account.
When you create an account you will be required to choose a password to maintain your account security. It is your responsibility to maintain the confidentiality of your password and account information. Moto shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account. Should you become aware of or suspect any unauthorised use of your password or account, please contact us on customer.services@moto-way.co.uk.
If Moto is suspicious of any activity in relation to your account (e.g. where it appears that fraud may have occurred), we reserve the right to refuse you access to your account and/or to suspend or delete the account, without liability.
In order to ensure that your personal data is not held for longer than necessary, if your account has been inactive for a 12 month period, then it will be considered dormant and you will receive an email requesting that, if you wish to reactivate your account, you log back in within the next 30 days. If you do not log back in within this period then your account will be deleted.
Your Order
Food products pictured on the menus are an indication of the product to be supplied and may not be identical; for example, any garnish/ decoration may differ.
Completion of the online checkout process constitutes your offer to purchase products from us. We will notify you by email as soon as possible to acknowledge that we have received and are processing your order.
Our acceptance of your order will take place only when we take payment from you and prepare the product(s). Prior to preparing the product(s) Moto has the right to decline an order for any reason.
Moto uses reasonable endeavours to ensure that products on its website are fairly described and prices are correct. However, we will only accept orders where there have been no material errors in the description or price.
You will need to show proof of your order and order number to the appropriate Moto employee before you can collect your order.
Where we have agreed delivery of an order to your vehicle, Moto will contact you by SMS message once your order is ready.
You should check the products you receive immediately on collection/receipt. If there are any problems with your order (for example, incorrect supply of products or unsatisfactory product) you should inform us as quickly as possible. We may offer you replacement products and/or a refund, as appropriate. (Refunds may only be given via the payment card used for the original payment).
If Moto cannot supply you with a product you have already paid for, we will not process your order but we will inform you by email and process a refund as soon as reasonably possible.
Moto will not be liable for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.
Payment for Food and Beverage Orders
You can pay for Moto products either by credit or debit card (“Payment Card”). By using a Payment Card, you confirm that the card is yours.
When you enter your Payment Card details during the check-out process, and/or where you choose to store these details in connection with your account, please note that you are supplying these Payment Card details to a third party secure payment processor and Moto will not have access to your actual payment card details although we have a contract in place with the payment processor to hold your data securely. N.B. Please see our privacy policy for further information about Moto’s uses of your data.
All card payments are subject to authorisation by your card issuer.
We will do all that we reasonably can to ensure that all of the information you give us when paying for the goods is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part, any failure by us to comply with this contract or our Privacy Policy (see clause 3) or breach by us of our duties under applicable laws we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.
Liability in relation to Orders of Food and Beverages
Any products we supply to you will be of satisfactory quality. If we supply a product to you that is not of satisfactory quality, you can contact us for a replacement or, where this is not possible, for a refund.
These Terms of Sale do not affect your statutory rights as a consumer. For more information on your statutory rights please contact your local authority Citizen’s Advice Bureau or Trading Standards Department.
To the extent permitted by law we will not be liable to you for any consequential losses that arise as a result of our breach of these Terms of Sale; or any losses which are incurred by any business of yours; or any losses which are a result of matters caused by circumstances outside of our control.

If you have a complaint about a product, a store or the customer service you received in store, if possible, please raise the complaint during your visit by speaking to a manager. 8. LEGAL, INCLUDING LIMITATION ON OUR LIABILITY
These website terms and conditions are governed by and construed in accordance with English law and save as set out, the courts of England shall have exclusive jurisdiction.
Nothing in these Terms and Conditions shall exclude or limit Moto’s liability for personal injury or death caused by our negligence or for fraud, or for any other liability that we are not permitted to limit or exclude under applicable law.
Save as set out in clause 8.2 Moto excludes:
- all representations, warranties, conditions and terms (whether express or implied by statute, common law or otherwise) to the fullest extent permitted by law;
- all liability for any special, consequential or indirect losses or damages;
- all business losses and losses to non-consumers
- any losses or damage which are not reasonably foreseeable, arising out of or in connection with these Terms and Conditions or your use of this website.
If any provision of these terms shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
You may not assign or sub-contract any of your rights or obligations under these website terms to any third party unless we agree in writing.
