Please note that the following terms apply (i) when you sign up to be on our marketing database; and/or (ii) when you sign up to take part in future customer research activities, (such as surveys and questionnaires) and/or prize draw opportunities; and/or (iii) when you respond to customer research activities and/or enter a prize draw, but without signing up to take part in future customer research activities and/or prize draws:
- The Data Controller, to whom you are providing your details, is: Moto Hospitality Limited, Toddington Service Area, Junction 11/12, M1 Southbound, Toddington, Bedfordshire, LU5 6HR.
- You must be aged 18 or over in order (i) to subscribe to receive marketing materials from us; and (ii) to subscribe to take part in and/or to participate in customer research activities and prize draws. Marketing and customer research communications may be sent to you by email or made available by other electronic means or by any other contact method to which you agree.
- When you submit your name and contact details to us and sign up to receive as applicable (i) marketing information, including our offers and promotions; and/or (ii) communications relating to customer research activities (such as questionnaires and surveys) and prize draws; you are giving us your consent to use your personal information for this purpose.
- In addition to your contact details (name, address and email address) we will also process the information you provide to us, such as your comments and opinions in response to our customer research. We process this personal information, as it is in our legitimate interests to do so, (i) in order to verify your customer research responses; (ii) for our analytics purposes, including to study our customers’ use of, and satisfaction with, our products and services, to enable us to develop them, to grow our business and to inform our marketing strategy, and (iii) to create aggregated, anonymous data, from which individuals cannot be identified. We may also use your data for other purposes which are legally required or permitted (which may include our requirements to maintain records and/or where it is necessary for the establishment, exercise or defence of legal claims.
- Where you have a My Moto account, your marketing and/or customer research preferences will be linked to your My Moto account, in order to allow you to control your database preferences, so you can opt in or out at any stage, and in order to allow Moto to respond more effectively to you, including in relation to your queries and feedback and the exercise of your data rights. Your marketing and/or customer research preferences will be stored in accordance with the My Moto terms.
- Where you do not have a MyMoto account, but you have subscribed to receive marketing and/or customer research, we will retain your details in the marketing and/or customer research and prize draws database(s), as applicable, for 3 years from the date on which we had our final interaction with you, which may include, where applicable, your submission of feedback to Moto’s customer services, and/or where you open/respond to any marketing emails or customer research communications. After this time we will send you an email asking whether you would like your details to continue to be held on the relevant database(s). If we don’t hear from you within 14 days we will automatically delete you from the relevant database(s), unless we are legally required to retain this information or it is necessary for us to retain it for a longer period, for example in connection with a claim. Where you have participated in a customer research activity and/or a prize draw but (i) you do not have a MyMoto account; and (ii) you have not signed up to take part in any future customer research/prize draws, your personal information will be retained for up to 6 months from the date of submission, following which it will be permanently deleted.
- We will not generally share your personal data with any third parties, except for our data processors, who process and store the data on our behalf, where we have entered into an appropriate contract with them. Our data processors may process some data outside the EEA/UK. Our current data processors are:

- In addition, where you are chosen as the winner of a prize draw, by accepting the prize, you give Moto permission to publish your details, in the following format: first initial, surname, county (e.g. J Smith, Bedfordshire), up to 6 months after accepting the prize. If you do not want your initial, surname and county published, you must notify Moto within a reasonable period of time before the end of the Prize Draw Period. We may also share your data where we are legally required or permitted to do so (for example with external advisers or insurers) or where Moto, or substantially all of its assets, is acquired by a third party, in which case such personal data held by Moto will be one of the transferred assets.
- You may at any time ask us to stop sending you communications relating to (i) our offers and promotions; and/or (ii) customer research and prize draws, either by unsubscribing to any email we send you, or by contacting: dataprotection@moto-way.co.uk. Please note that you must clearly specify in your email the purpose of your email to us, in order for action to be taken.
- You can ask us for access to the data we hold about you, or to rectify or erase your personal data or in some circumstances to restrict our processing of your data.
